1 charge of fraudulently obtaining benefits contrary to s116 of The Transport Accident Act 1986 and 1 charge of supplying false information to the TAC contrary to s117 of The Transport Accident Act 1986.
The accused was sentenced with conviction to perform 150 hours of unpaid community work and undergo a mental health assessment and treatment as part of a 12 month Community Correction Order. The accused was also ordered to pay TAC compensation in the amount of $31,700.55.
The accused had been earning an income whilst in receipt of Loss of Earnings benefits and failed to advise the TAC of this income while at the same time submitting 11 forged Certificates of Capacity advising the TAC that he had no capacity to work and that the accused had not returned to work. As a result the accused received $31,700.55 in benefits fraudulently.
