1 charge of fraudulently obtaining benefits contrary to s116 of The Transport Accident Act 1986 and 4 charges of providing false or misleading information contrary to s117 of The Transport Accident Act 1986.
Prior to the plea on the 5th June the accused had commenced repaying money to the TAC on 4th June in the amount of $700.00. The magistrate imposed a conviction and sentenced the accused to a 24 month Community Corrections Order with conditions that the accused be under the supervision of the Office of Corrections for the duration of the order. The accused must perform 240 hours of unpaid community work and be treated for drug addiction. The accused was also ordered to pay TAC compensation in the amount of $24,286.12.
The accused provided the TAC with false pre-accident prospective employment documents, which included a fake email address for the prospective employer which TAC used to confirm some of the prospective employment details. The accused then also supplied the TAC with a fraudulently altered Certificate of Capacity and a fabricated Certificate to continue to receive Loss of Earnings Benefits. Consequently the accused received a total of $24,286.12 in Loss of Earnings Benefits fraudulently.
