1 charge of fraudulently obtaining benefits contrary to s116 of The Transport Accident Act 1986.
The magistrate sentenced the accused with a finding of guilt to perform 200 hours of unpaid community work and undergo treatment and rehabilitation as part of a 12 month Community Corrections Order. The accused was also ordered to pay the TAC compensation of $38,643.60, resulting in the accused obtaining benefits fraudulently.
The accused had been earning an income whilst in receipt of Loss of Earnings Benefits and failed to advise the TAC of this income whilst at the same time submitting Certificates of Capacity advising the TAC that the accused had not returned to work.
