1 charge of fraudulently obtaining benefits contrary to s116 of The Transport Accident Act 1986 and 1 charge of providing false information contrary to s117 of The Transport Accident Act 1986.
The magistrate imposed a conviction and sentenced the accused to a 12 month Community Corrections Order with conditions that the accused be under the supervision of the Office of Corrections for the duration of the order. The accused was ordered to perform 200 hours of unpaid work and undergo assessment and treatment for drug and mental health issues. The accused was ordered to pay compensation to the TAC in the amount of $14,814.72.
The accused provided TAC with false and/or forged Certificates of Capacity to substantiate the accused’s on-going claim for Loss of Earnings benefits. As a result of the forged Certificates of Capacity being supplied the accused received $14,814.72 fraudulently.
