One charge of fraudulently obtaining benefits contrary to s116 of The Transport Accident Act 1986 and two charges of providing false information contrary to s117 of The Transport Accident Act 1986.
The accused was sentenced with conviction to a 12 month Community Corrections Oder during which the accused is to perform 200 hours of unpaid work. The accused was ordered to pay TAC $7,995 in compensation.
The accused was the mother of a child whose father died in a fatal collision and was the recipient of surviving dependent benefits. The accused provided TAC with two false letters from her child’s school claiming that the child remained a full time student after attaining the age of 16. The letters were forged by the accused and the child had exited school at the age of 15. As such the accused received $7,995.00 in surviving dependent benefits to which the accused was not entitled.
