TAC successfully prosecuted the accused in the Magistrates’ Court.
The accused was charged with fraudulently obtaining benefits and providing TAC with false and misleading information as a result of a TAC investigation.
The accused was involved in a transport accident in August 2023 as a motor bike rider which was cut off by an unknown vehicle. The accused sustained injuries which included cuts to hands and ankle, soft tissue injury to the left knee and lower back pain as a result.
The TAC investigation resulted in evidence being obtained which indicated that the accused pre-accident payslips were false and the accused’s alleged employer had in fact never employed the accused.
The accused plead guilty after initially failing to appear to answer the charges and was represented at the hearing.
After hearing a summary of the offending, the court heard submissions from the accused’s legal representative and the Prosecution. The Prosecution submissions centered on the need for general deterrence while defence submissions centered on the appropriate disposition being a fine.

With Conviction, a Community Corrections Order for 18 months with condition to perform 150 hours of unpaid community work. The accused was also ordered to pay TAC compensation in the amount of $14,792.87 and TAC’s legal costs of $5,302.
