2 charges of fraudulently obtaining a benefit from the TAC contrary to S116 of the Transport Accident Act 1986 and 2 charges of providing false or misleading information to the TAC contrary to S117 of the Transport Accident Act 1986.
The accused was sentenced and convicted by the magistrate and ordered to undertake a 12 month Community Corrections Order (CCO) which included conditions that the accused perform 120 hours of unpaid work and undergo assessment and treatment for mental health issues. The accused was also ordered to pay the TAC compensation in the total amount of $25,628.82.
The accused received Loss of Earnings benefits but during receipt of the Loss of Earnings had returned to work without advising the TAC of the return to work.
