2 charges of fraudulently obtaining benefits contrary to s116 of the Transport Accident Act 1986.
The magistrate imposed a 12 month Community Corrections Order with a finding of guilt, ordered the accused to complete 150 hours of community service, pay professional costs of $500 and pay restitution to the TAC of $19,530.07 (being the balance of the benefits yet to be repaid to the TAC as the accused, prior to the plea had made repayments to the TAC of $21,400).
Following the transport accident the accused had continued to earn income from employment, while also receiving loss of earnings and loss of earnings capacity benefits. Further, the court was advised that during the period in which the accused had received Loss of Earnings and Loss of Earnings Capacity the accused continued to submit to the TAC Certificates of Capacity indicating that the accused had not returned to employment.
