1 charge of fraudulently obtaining benefits contrary to s116 of The Transport Accident Act 1986 and 1 charge of supplying false information to the TAC contrary to s117 of The Transport Accident Act 1986.
The accused was convicted, fined $2,500 and ordered to pay compensation to the TAC in the amount of $36,214.14 (a stay to 22/09/2019 was granted).
The accused was involved in a motor bike accident but in the accused’s claim to the TAC the accused alleged he was riding his friend’s motor bike at the time which was registered. TAC investigations revealed that the accused was not riding the motor bike he alleged but in fact was riding an unregistered motor bike. Consequently the accused received $36,214.14 in Loss of Earnings benefits he was never entitled to.
