Nature of Offences (Including Act, Section & No of Counts)
One charge of obtaining benefits fraudulently contrary to s116 of the Transport Accident Act 1986 and one charge of supplying false information contrary to s117 of the Transport Accident Act 1986.
The magistrate sentenced the accused by convicting him and placing him on a 12 month CCO with conditions that he be supervised by the office of corrections for the duration of the order and he perform 100 hours of unpaid community work. He was also ordered to pay compensation to the TAC in the amount of $53,238.71 and costs of $500.
The accused was receiving Loss of Earnings benefits while at the same time submitting to the TAC forged Certificates of Capacity indicating that the accused had no capacity for employment. It was then discovered that the accused had actually returned to work without advising the TAC.
