Meadow Heights man found guilty of defrauding the TAC

A Meadow Heights man has been ordered to repay more than $25,000 to the Transport Accident Commission (TAC) for defrauding the scheme.

Ercument Gunduz pleaded guilty in the Broadmeadows Magistrates Court this week to one charge of fraudulently obtaining a benefit by failing to advise the TAC of a return to work contrary to Section 116 of the Transport Accident Act 1986.

Following a transport accident in November 2011, Mr Gunduz had returned to paid employment as a consultant between January 2012 and July 2012.

However, he continued to receive loss of earnings payments from the TAC during this six-month period.

After pleading guilty to the charge, the Magistrate ordered Mr Gunduz to pay a $5,000 fine, restitution in the sum of $27,124 and $1,000 in professional costs.

The TAC has a responsibility to the community to ensure the financial health of the TAC scheme so that it can continue to look after injured Victorians.

As such, the TAC takes fraud very seriously and where there is evidence of misconduct, the TAC will exercise its strong legislative powers to investigate and prosecute.
