One charge of fraudulently obtaining benefits from the TAC contrary to s116 of The Transport Accident Act 1986 and 1 charge of providing false or misleading information to the TAC contrary to s117 of The Transport Accident Act 1986.
The magistrate convicted and fined the accused, ordered the accused to pay TAC compensation in the amount of $26,243.85 and to also pay TAC’s professional costs of $1,320.
The accused returned to pre-accident employment as a forklift driver with different employers without advising TAC of a return to work. At the same time the accused continued to supply the TAC with Certificates of Capacity that stated that the accused had no capacity to return to work and all acknowledged by the accused that the accused had not returned to work.
